Recent indictments for worker misclassification, misappropriation of fringe benefit dollars and misclassification of independent contractors are serious reminders that not properly following Prevailing Wage (PW) rules can have grave consequences. The latest rulings will be discussed as well as what you need to do to successfully navigate pitfalls on PW projects.
Thomas R. Davies, Esq., Harmon & Davies, P.C. serves as a Partner in Harmon & Davies, P.C., Lancaster, Pennsylvania office. He concentrates his practice on the representation of employers in labor and employment related matters. Tom regularly speaks on labor and employment related issues at seminars for personnel professionals, attorneys and business leaders. He has also testified on labor issues before Committees of the United States House of Representatives and the Pennsylvania Legislature.
Prior to partnering with Rick Harmon to form Harmon & Davies, P.C. in 1987, Tom served as a Trial Attorney with the National Labor Relations Board in Pittsburgh, Pennsylvania. During his twelve years with the NLRB, Tom investigated more than a thousand unfair labor practice cases, conducted more than a hundred representation elections and tried many cases to successful conclusion.
Tom earned his Juris Doctor from Duquesne University School of Law in 1981 and his Bachelor Degree from Lafayette College in 1974. Tom is admitted to the Pennsylvania Bar, as well as the U.S. Courts of Appeals for the Third, Fifth, Seventh, Ninth and D.C. Circuits, and the U.S. District Courts for the Eastern, Middle and Western Districts of Pennsylvania, as well the Central and Northern Districts of Illinois. He is a member of the Keystone, Central Pennsylvania and Cumberland Valley Chapters of ABC. Tom had the honor of serving as the 2009 Chairman of the Board of the Keystone Chapter of Associated Builders and Contractors.
