Description:
Strong contracts and a clear understanding of payment procedures are essential to keeping construction projects on track and profitable. This session walks participants through the structure, terminology, and key clauses of construction agreements—from contracts to subcontracts to purchase orders—and shows how to manage payments, change orders, lien rights, and legal protections. You’ll leave better equipped to recognize red flags in agreements, understand your rights and obligations, and ensure timely and proper payment on your jobs.
Learning Objectives:
By the end of this session, participants will be able to:
- Understand the structure and function of construction agreements, including AIA and ConsensusDocs.
- Identify and negotiate key contract clauses related to scope, delays, warranties, and risk.
- Manage change orders, schedule of values, and applications for payment effectively.
- Navigate lien rights, waivers, and the Pennsylvania Construction Notices Directory.
- Apply best practices under CASPA and Prompt Pay Acts to protect payment rights.
- Recognize the difference between “pay-when-paid” and “pay-if-paid” clauses and how courts interpret them.
