This discussion will include a review of common terms contained in construction agreements and those terms that are routinely negotiated. A guest speaker from McConkey Insurance & Benefits will address insurance terms contained in construction agreements and issues that may arise with insurance throughout the contracting process. The S&S Team will also explain the different forms of claim processes and issues that can arise throughout the resolution of a construction claim. Case studies illustrating common industry pitfalls will be provided.

Katy S. Landis, Esq. focuses her practice in commercial litigation, construction litigation and healthcare litigation. She represents doctors, hospitals, and other healthcare providers in medical professional liability cases. Ashley Nichols, Esquire litigates all types of construction claims, including claims for lost profits and delay damages, and warranty and workmanship claims. Ashley drafts and reviews contracts in an effort to mitigate lawsuits. She also provides counseling and claims avoidance advice. She participated in the American Bar Association’s Forum on Construction Law Trial Academy, a rigorous training program that focuses on trial skills and is instructed by accomplished construction litigation experts.
Ronald Pollock, Esq., Chair of the Construction Law Group, focuses his practice in construction litigation and has significant experience in insurance and medical device litigation and alternative dispute resolution (ADR). Within the area of construction, Ron specializes in litigation, indemnification and bid challenges, and assists in reviewing contracts and agreements to help clients avoid potential lawsuits as a form of risk management. He speaks frequently with industry leaders and writes articles dealing with construction contract preparation, interpretation and administration.
Marcus W. Shand, Esq. focuses his practice in healthcare litigation, representing doctors, hospitals, and other healthcare providers in medical professional liability cases, as well as labor and employment and construction litigation.
Tim Ziegler, CRIS – McConkey Insurance & Benefits – Tim joined McConkey 5 years ago to lead their construction practice. In his role, Tim oversees risk management, insurance carrier relationships, and analyzing coverage forms as it pertains to McConkey’s construction clients and assists the agency’s largest construction clients in managing their risk. Tim’s training as an underwriter in a national insurance company’s construction division set the framework for an understanding of policy forms that allows him to identify coverage gaps that many overlook. He enjoys the challenges of interpreting contract terms, negotiating coverage requirements with owners and subcontractors, and finding solutions to the complex problems contractors face when trying to manage their risk.
